For your safety, do NOT answer any questions from a law enforcement officer without an attorney present. Routinely, we find that it's very difficult for the prosecution to convict, if clients exercise their right to remain silent. If you have been arrested, an admission on the spot will not lessen your charges. Also, do not consent to any search of yourself or your property. Make the law enforcement officer provide a search warrant signed by a judge.

A lawsuit (or suit in law) is "a vernacular term for a suit, action, or cause instituted or depending between two private persons in the courts of law." The term refers to any proceeding by a party or parties against another in a court of law. A civil case begins when a person or entity (such as a corporation or the government), called the plaintiff, claims that another person or entity (the defendant) has failed to carry out a legal duty owed to the plaintiff. A civil action is also an action that is brought to enforce, redress or protect a private or civil right. If the action is brought by a private person, it is termed as private action. If brought by the government, it is termed as public action.
A civil lawsuit or civil suit, as opposed to a criminal case, involves the rights of private citizens and their civil rights or their right to recover compensation for a civil injury. Common examples of civil cases include contract violations, personal injury, property damage, medical malpractice cases, birth injury accidents, motorcycle accidents, car accidents, and breach of contracts. A civil case settles a personal or business conflict when an individual or group feels wronged by a defendant or cannot come to an agreement on an existing legal matter.

Personal injury is a legal term for an injury to the body, mind or emotions, as opposed to an injury to property. It is considered a type of tort lawsuit in which the person bringing the suit, or "plaintiff," has suffered harm to his or her body or mind. Personal injury lawsuits are filed against the person or entity that caused the harm through negligence, gross negligence, reckless conduct, intentional misconduct, or under basis of strict liability. Damages awarded to the victim typically include the injured person's medical bills, pain and suffering, and diminished quality of life.
Every tort claim, regardless of its basis, whether intentional, negligence, or strict liability, has two basic issues—liability and damages. If the other side is liable, we then look at the extent of your injuries in seeking appropriate compensation. Automobile accidents provide a good example of how the tort system works. You have a negligence claim in a "fault" state if you are injured by a driver who failed to exercise reasonable care. Drivers have a duty to exercise reasonable care anytime they are on the road. When they breach that duty and your injury results, personal injury law says the other side is responsible for your costs and pain. Negligence reaches far beyond claims stemming from car accidents. It is the basis for liability in most personal injury lawsuits, including medical malpractice.
